近年来,随着城市化进程的推进,拆迁问题不断凸显,各地拆迁纠纷不断.主要原因还是在于我国特有的城市房屋拆迁补偿制度尚不完善,不能切实保障被拆迁人的合法权益.那么,被拆迁人的合法权益如何得到确实的保障呢?我想,核心在于解决好房屋拆迁中的补偿问题.补偿的标准是否合理,程序是否透明,补偿方式是否得当以及补偿不公时是否有合理公正的救济途径直接关系到能否满足被拆迁人的利益需求、解决好拆迁中出现的问题.然而,综观我国目前的行政补偿制度,还是相当的落后,如没有统一的行政补偿立法,各个领域的单行立法比较笼统,缺乏灵活性等等.因此,在目前我国正进行的大规模经济建设、城市拆迁改造的任务十分艰巨的形势下,确立更加合理的补偿机制、补偿程序,并在国家相关法律中予以明确的规定,从而更好的保护公民的合法权益,有着非常重要的现实意义.本文就城市房屋拆迁行政补偿问题进行探讨,对于城市房屋拆迁的性质、特征、应遵循的原则以及现有房屋拆迁补偿制度的存在问题和不足等方面进行了分析,结合我国的国情,提出了自己的一些相关建议.

Abstract:
In recent years,relocation problem keep arising with the process of urbanization.Disputes happen in a lot of places.The primary reason is that the imperfection of the unique compensation system in our country,which can not effectively protect people's legal rights.Then how can we ensure that?I think the key is to solve the compensation problem during the process of relocation.Whether the standard is reasonable,the process is open,the compensation is fair and the welfare system is working directly relates to the right of those who are being relocated.However,an overview on the official compensation regulation of our country will reveal its flaws.For instance,there is no universal laws and the existing law is rather ambiguous and lack of flexibility.Therefore,under the circumstance that our country is experiencing mass economic construction and relocation tasks are rather tough,making more reasonable compensation system and process while at the same time regulate clearly in relevant laws so as to protect citizens' legal rights has urgent significance.The essay discuss about the compensation problems in urban relocation,analyze the character,property,principle and existing problems of existing compensation system,and offer some original suggestions on the basis of our coutry.
